Associate Attorney Chris Kiernan Voids Sheriff’s Sale to Save Client’s Title!

Associate Attorney Chris Kiernan of The Ryan Firm obtained a complete victory for our client, avoiding near half-million-dollar loss.  The case stemmed from a dispute relating to a series of foreclosures of property in Los Angeles County. The client’s purchase from a nonjudicial foreclosure sale was later threatened by a subsequent sheriff’s sale.  Through swift advocacy, the client’s title and purchase were fully protected. Several months later, the Los Angeles Sheriff’s Department conducted an execution sale of the property based on a judgment lien that was junior to the already-foreclosed senior deed of trust.  Our client’s title should not have been impacted because the judgment lien was extinguished by our client’s foreclosure sale.  But the sheriff's sale went forward nonetheless and the Sheriff refused to set its sale aside.  Through swift procedural maneuvering and deft advocacy, Chris successfully moved the superior court for summary judgment on all our client’s claims.  Chris's complaint and corresponding motion for summary judgment sought restoration of our client's title and cancellation of any adverse claims to title.  The Superior Court granted the motion for summary judgment in full and our client's rightful title was restored with minimal interruption.  Chris obtained complete victory in this case in mere months.
