We voided a subordination agreement to save GSE lien priority!

Andrew Mase, The Ryan Firm Litigation Manager, won a bench trial for major Government Sponsored Enterprise in a unique real property dispute concerning issues related to an unauthorized subordination agreement wherein the former loan servicer subverted the GSE’s lien interest without appropriate authorization or notice to the GSE. After defeating a summary judgment motion from the defense, Andrew Mase proceeded to try the case to judgment in favor of the GSE in a multi-day (very technical) bench-trial. Successful prosecution of the equitable claims included in-depth analysis and presentation of evidence concerning the circumstances of the execution and recordation of the unauthorized subordination agreement. The Ryan Firm was able to ensure that the client recovered all of its attorney’s fees for this multi-year effort!
